NOTICE CONCERNING THE COLLECTIVE BARGAINING AGREEMENT OF THE UNIVERSITY "SAINT CLEMENT OF OXHRIDGE" IN SKOPJE

The Rectorate informs the public that at the extraordinary session, held on 8 February 2024, at which the Collective Agreement of the University 'St. Cyril and Methodius' in Skopje was discussed, it adopted the following

 

C o n c l u s i o n s

 

  1. The Collective Agreement of the University 'St. Cyril and Methodius' in Skopje is in force, in legal circulation since 1 January 2024, has not been terminated, nor repealed or annulled, and is binding on the employer and the workers on whose behalf it was concluded.
  2. The University 'St. Cyril and Methodius' in Skopje, with particular concern for the position of its employees and the realisation of their rights from the employment relationship, states that the allegations of the Ministry of Education and Science and the Ministry of Labour and Social Policy are completely unfounded and unlawful, regarding the validity of the individual Collective Agreement of UCM, with the unlawful assertion that it is not registered in the Register of Collective Agreements, which is maintained by the Ministry of Labour and Social Policy. Namely, according to Article 231, paragraph 1 of the Law on Labour Relations, registration is mandatory for general and sectoral collective agreements, and not for individual collective agreements, such as the Collective Agreement of UoK, for which, according to paragraph 3 of the same article, only notification to the Ministry of Labour and Social Policy is required.
  3. The Rectorate of the University "St. Cyril and Methodius" in Skopje has noted that the state does not honour the acts it itself enacts, which is contrary to the principles of the rule of law and legal certainty.
  4. The University 'St. Cyril and Methodius' in Skopje and the Union of Trade Unions of the University's employees are requesting an urgent meeting with Prime Minister Talat Xhaferi within three days, who, incidentally, is also a signatory to the Collective Agreement of UKIM.
  5. The University's employees and the Trade Union will take appropriate measures to protect and exercise their rights guaranteed by the Constitution and the laws.
Regarding the non-compliance with the Collective Agreement of UKIМ, the following institutions were notified by letter dated 5 February 2024: the Assembly of the Republic of North Macedonia, the Government of the Republic of North Macedonia, the Ministry of Education and Science, the Ministry of Finance and the Ministry of Labour and Social Policy.
